    PWD TERMS & CONDITIONS OF SERVICE

    Prior to any event that is booked with Posh Wedding Discos®, the client agrees to the PWD Terms & Conditions of Service. A copy of these Terms & Conditions of Service can be found in the footer at www.poshweddingdiscos.com and is also included in the PWD Welcome Pack. A signature on your PWD Booking Confirmation Form and a Deposit is required to secure any booking. The Contract is a guarantee that we will provide the service that is specified, and you will pay the fee that is specified.

    PAYMENT TERMS

    • To secure your booking and save your date we require a £99 Non-Refundable Deposit. By paying this Deposit you are agreeing to the PWD Terms and Conditions of Service outlined below.
    • The balance is to be paid in full no later than 30 days prior to the event date. The agreed fee payable is in respect of the PWD Package as outlined in the client’s PWD Booking Confirmation Form and includes the £99 Deposit paid. This agreed fee is the MINIMUM amount for which Posh Wedding Discos® products and services will be rendered.
    • A planning meeting and drawing up of the PWD Contract will give opportunity for the client to upgrade their chosen PWD Package or opt for any Added-Extras and to agree the fee, which may lead to a greater fee than the fee agreed on booking.
    • A Deposit Refund will be given if a client requests the return of their deposit within 14 days of making the booking. After which time the Deposit becomes a Non-Refundable Deposit. A refund request in writing will be required for audit purposes.
    • Posh Wedding Discos® reserves the right to offer and withdraw discounts or promotions subject to availability, as per the Consumer Rights Act 2015.
    • A variety of payment methods are available for client convenience. Payment may be made by BACS transfer Lloyds Bank - Sort Code 77-22-37 Account Number: 689 201 68 or online via the website at poshweddingdiscos.com or by PayPal. In person at Wedding Fayres with debit/credit/ apple/google pay via Posh Wedding Discos POS and over the phone using most major debit/credit cards, or by cheque made payable to Neil Bird and sent with the client’s details through the post to PO Box 11118, Nottingham, NG2 9YD, United Kingdom. Details of flexible payment plan options are given in the Posh Wedding Discos® Welcome Pack & at www.poshweddingdiscos.com
    • Payments may be made by installments to spread the cost for the client, if required. The number of installments and intervals will be finalised and agreed between Posh Wedding Discos® and the client on booking or at the planning meeting and signing of the PWD Contract. The payment schedule will be dependent on the period from the booking date to the 30 days prior to the event date, when all fees must be paid in full. Invoices will be raised to request payment from the client according to the schedule agreed. Each installment must be paid within 7 days.
    • The payment method, payment plan and fee will be agreed and stated on the PWD Contract, along with the products and services to be rendered. The finer details of specifics will be stated on the PWD Event Plan Checklist which will be agreed before signing of the PWD Contract.

    CANCELLATION TERMS AND REFUND POLICY

    • Posh Wedding Discos® reserves the right to cancel the event if payment has not been received in full 30 days prior to the event.
    • We will be willing to re-schedule your booking, if possible; this will be dependent on our availability on the revised date, which cannot be guaranteed. Should the booking be re-scheduled then the PWD Terms and Conditions of Service and refund policy apply, as before, to the revised date.
    • Any PWD Contract cancellation by either party does not affect the Deposit which is Non-Refundable.
    • Cancellations by the client must be made in writing or via email. For audit purposes we cannot accept cancellations over the phone.
    • The PWD Booking Confirmation is a legal and binding agreement, and for audit purposes the Deposit will only be refunded if requested with written confirmation within 14 days of booking.
    • The PWD Contract is a legal and binding agreement. If the customer cancels within 30 days of the event there is a 100% cancellation fee. Cancellations outside of this period require no fee, and in this instance any monies paid via an instalment plan will be refunded, excluding the deposit of £99 which is non-refundable and the refund administration fee of £50.
    • Once notice of cancellation is received and payment finalised Posh Wedding Discos® exercises the right to treat the PWD Contract as at an end.

     

    PACKAGES AND SERVICES

    • Posh Wedding Discos® Packages and services will be provided as stipulated and agreed on the client PWD Booking Confirmation Form, the client PWD Contract & the PWD Event Plan Checklist.
    • Additions can be made to the PWD Contract after the fact for a fee. Reductions cannot be made to the PWD Contract after the fact.
    • Posh Wedding Discos® will not be held responsible for circumstances outside their control which may pose risk to clients, guests, venue staff and/or DJs. As such, Posh Wedding Discos® reserves the right to use their discretion when delivering a safe and effective first-class professional service.
    • Extra charges may apply for extending DJ playing times after midnight.
    • Extra charges may apply for changes to the agreed PWD Contract.
    • Extra charges may apply for time/travel to/from venues located outside a 25-mile radius of Nottingham, or for over-night expenses.

     

    AMENDMENTS

    • The original agreed fee on the PWD Booking Confirmation Form is the minimum amount for which Posh Wedding Discos® products and services are rendered.
    • Clients can upgrade their booking by purchasing extra products or services from “Added-Extras” at a later date. The costs will be either added to their original invoice for final payment, their payment plan updated, or a separate invoice raised.
    • Subject to exceptional circumstances beyond their control, Posh Wedding Discos® reserves the right to amend the agreed plan on the day of the event to ensure safe delivery of an effective first-class professional service.
    • Every effort will be made to accommodate changes in event timing. Re-timing may be subject to an additional fee and/or Posh Wedding Discos® availability.
    • Every effort will be made to accommodate rescheduling the date of the event for the client if their need arises. Rescheduling is, however, subject to Posh Wedding Discos® availability.
    • Where Posh Wedding Discos® cannot fulfil the client rescheduled date the cancellation and refund terms apply.

    RESPONSIBILITIES OF CLIENT

    • Agree to a meeting, virtual or in person, to plan the event, communicate particulars & agree and sign the PWD Contract.
    • Provide suitable vehicle parking, venue access, adequate set-up time and space, notify of any restrictions and specific directions related to the venue, guests, & event.
    • Read & agree the event Risk Assessment & Event Overview.
    • Accept liability for damage or theft of any DJ equipment, or injury to the DJs due to their party.
    • Guarantee that you will pay the fee as specified by the PWD Contract & any subsequent invoice raised.
    • By completing the PWD Booking Confirmation Form, paying the £99 Deposit, signing the PWD Event Plan Checklist & PWD Contract, the client agrees to the PWD Terms and Conditions of Service.

    RESPONSIBILITIES OF POSH WEDDING DISCOS

    • Schedule a meeting, virtual or in person, to plan the event ensuring clear communication of requirements and particulars for both parties. Agree and sign the PWD Event Plan Checklist & PWD Contract.
    • Agree timings with the Client; for example, but not exclusive; set-up, music start, first dance, total running, de-rig, and close times.
    • Create Risk Assessment & Event Overview for agreement with client
    • Although all equipment is checked regularly & all reasonable steps are taken to ensure suitable backup equipment is available, Posh Wedding Discos® will not be responsible for particulars of the booking that are not produced due to technical failure beyond their control.
    • Guarantee that we will provide the service as specified by the PWD Event Plan Checklist & PWD Contract & any subsequent invoice raised.
    • By completing the PWD Booking Confirmation Form, accepting payment of the £99 Deposit, signing the PWD Event Plan Checklist & the PWD Contract, Posh Wedding Discos® agree to the PWD Terms and Conditions of Service.

     

     

     

     

    GDPR/MEDIA PERMISSIONS

    • Posh Wedding Discos® assign the copyright of photography or videography.
    • The Client allows Posh Wedding Discos® to display any photograph or video covered by this Contract to promote its business in advertising, brochures, magazine articles, social media, websites, blogs, sample albums and prints, venue and other vendor samples, and other such material, providing that the images used are used lawfully and without damage to the Client.

    FORCE MAJEURE

    • Whilst every effort is made to ensure a smooth running of all events, Posh Wedding Discos® cannot be held responsible or liable for circumstances beyond their control.
    • A “Force Majeure Event” occurs where a party is unable to comply with its obligations under this Contract for a reason outside of its control (such as but not limited to, war, fire, death, illness or other capacity certified by a properly qualified medical practitioner, epidemic, pandemic, accident, civil commotion, national calamity, order of Government or Local Authority having jurisdiction in the matter, changes in law, foreign government policy, act of God) and which is not attributable to any act or failure to take preventive action by Posh Wedding Discos® or their client.
    • In any event of Force Majeure, no liability for any costs or expenses incurred by the client or any associated third party are accepted by Posh Wedding Discos® in the event of cancellation or postponement. Our maximum liability arising out of, or in connection with, the non-supply of services shall be limited to the total value of the PWD Contract in pounds, minus the £99 Non-refundable Deposit.
    • In the event of Force Majeure, the affected party shall have to prove it, providing evidence that they took out any possible action to prevent the circumstance from happening, should any have been possible.
    • In a proven case of Force Majeure occurring for a specified period, Posh Wedding Discos® and the client will endeavour to reschedule where possible and the Contract may be transferred to the new scheduled date where this occurs. If Posh Wedding Discos® cannot reschedule, they will use their best efforts to find a new DJ for you. If, in these circumstances, a new DJ is found for the same or lower DJ Fee, then no additional Deposit will be payable and the Deposit will be transferred to this new booking. If the new DJ Fee is higher than the original Contract, any additional Deposit to confirm a Contract with a new DJ will be outlined to the Client and mutually agreed with the Client.
    • There is no penalty in the event the booking date is changed due to government public health restrictions. All deposits paid will be carried to your new date. In the event of a full cancellation, for this reason, the full balance will be waived with loss of deposit only to cover our set up and administration costs.

    BREACH OF CONTRACT

    Posh Wedding Discos® reserves the right to void any PWD Contract between themselves and the Client if it is discovered that the client has breached any of these PWD Terms and Conditions of Service.

    JURISDICTION

    The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of this PWD Contract.

    TERMS & CONDITIONS
